As prelude to the heated rhetoric that likely will accompany whatever DoMA challenges become future same-sex marriage front page stories, I here raise nine questions about same-sex marriage that I believe are fundamental for conflicts disputes. I divide the nine questions into three subgroups of three questions each. Group one focuses not explicitly on conflicts doctrine, but on other background issues. Group two deals with how traditional conflicts doctrine might apply to same-sex conflicts. Group three assesses whether DoMA’s attempts to settle same-sex marriage conflicts are constitutional under the Full Faith and Credit Clause.
