The criminal law area was one of my original law school teaching and scholarly fields. Here, though, I am not going to be focusing on such crucial legal policy issues as the fact that the United States is now the only major democracy that regularly uses  the death penalty to deal with convicted murderers. Instead, I will be addressing an underlying question of whether we should be maintaining or redoing two of our most popular crimes, smoking marijuana and betting with a bookie on who is going to be winning the Super Bowl or the World Series.
