Welcome to the New England Law Review Forum (“The Forum”), the online publication of the New England Law Review (“NELR”). The Forum is governed by these Terms of Service (“Terms”) and may be amended at any time at the discretion of its Executive Editorial Board and/or Faculty Advisor.

USE OF THE WEBSITE MEANS YOU, THE USER, AGREE TO BE BOUND BY THE TERMS. The Terms serves as a legal contract between you and the NELR so it is important that you review them carefully — if you do not wish to be bound to the Terms, please do not use The Forum.

Ownership: The Forum and the NELR are owned by New England Law | Boston. The Forum and the NELR are operated by a staff composed of both full-time and part-time students at New England Law | Boston, with its operations overseen by a designated Faculty Advisor.

Compliance with Applicable Laws: Agreement to the Terms is a condition precedent for your access and use of The Forum. You agree to refrain from any purpose that is unlawful or prohibited by these Terms and that you will comply with all applicable laws, as well as any conditions or restrictions imposed by the Terms.

Copyright: The Forum hosts scholarly materials related to the practice and discussion of law, written by legal academics and law students from New England Law | Boston. Thus, the content hosted on The Forum may only be used to the extent allowed by the principles of fair use — such as personal use or non-commercial use. If you would like broader rights, please contact the Executive Online Editor. All intellectual property rights not expressly granted here are reserved.

The NELR respects the copyrights of others — thus, if you believe in good faith that your copyrighted work has been reproduced on The Forum without authorization in a way that constitutes a prima facie case for copyright infringement, you may notify our Executive Online Editor with the following information:

  • Identification of the allegedly infringing material and supplemental information reasonably sufficient to allow the Executive Online Editor to locate the material;

  • Identification and production of the copyrighted work;

  • Your name and contact information, whether a telephone number or an email address;

  • A statement by you that you have a good faith belief that the use of the allegedly infringing material was not authorized by the copyright owner, its agent, or the law; and

  • A statement and signature, made under the penalty of perjury, that the information in your notice is accurate and that you are either the copyright owner or an agent authorized to act on the copyright owner’s behalf.

Trade and Service Mark Rights: All rights in the product names, company names, logos, service marks, trade dress, slogans, product packaging, and designs of The Forum, whether or not appearing in large print or with the trademark symbol, belong exclusively to the NELR, New England Law | Boston, or its licensors. The preceding is protected from reproduction, imitation, dilution, or confusing or misleading uses under national and international trademark and copyright laws. The use or misuse of these trademarks or any materials, except as permitted herein, is expressly prohibited and nothing stated or implied on The Forum confers on you any license or right under any patent or trademark of the NELR, New England Law | Boston, its affiliates, or any third party.

Privacy: Use of The Forum indicates that you understand the information, collection, use, and disclosure practices described in the Privacy Policy.

Third-Party Content and Links to Third-Party Websites: The Forum may contain third-party owned content and links to other websites (“Linked Sites”). With the exception of content linking to the New England Law | Boston website, the remainder of the Linked Sites are not under the control of the NELR or New England Law | Boston and thus are not responsible for the content or privacy practices of the Linked Sites.

No Endorsement: Unless explicitly stated, the NELR does not endorse any of the views, analysis, or opinions presented on The Forum, including from submissions specifically solicited by the Executive Editorial Board. You agree not to rely on any posted information as legal advice or a formal legal opinion.
